1. Introduction and Acceptance

These Terms of Service (“Terms”) govern your access to and use of BestFolio (the “Service”), a web-based tactical asset allocation analysis platform operated by BestFolio (“BestFolio”, “we”, “us”, or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Service Description

BestFolio is an informational and educational platform that provides:

  • Analysis of tactical asset allocation strategies based on published academic and practitioner research
  • Portfolio construction tools for self-directed investors
  • Historical backtesting data and performance metrics
  • Strategy signal tracking and monitoring

2.1 What BestFolio Is

BestFolio is a research and analysis tool. It aggregates, implements, and presents tactical asset allocation strategies that have been described in publicly available academic papers, books, and practitioner research. The Service is designed for self-directed investors who make their own investment decisions.

2.2 What BestFolio Is NOT

BestFolio is NOT any of the following:

  • A registered investment adviser, broker-dealer, or financial institution
  • A provider of personalized investment advice, financial planning, or portfolio management
  • A fiduciary with respect to any user
  • A provider of tax, legal, or accounting advice
  • A provider of recommendations to buy, sell, or hold any specific security

3. Important Financial Disclaimers

3.1 No Investment Advice

The content provided through the Service is for informational and educational purposes only and does not constitute investment advice, financial advice, trading advice, or any other sort of advice. You should not treat any of the Service's content as such.

BestFolio does not recommend that any particular security, portfolio of securities, transaction, or investment strategy is suitable for any specific person. The Service does not make personalized recommendations.

3.2 Past Performance

Past performance is not indicative of future results. Hypothetical or simulated performance results have inherent limitations. Unlike actual trading records, simulated results do not represent actual trading.

3.3 Backtesting Limitations

All backtested performance shown on BestFolio is hypothetical and subject to significant limitations, including but not limited to:

  • Backtests do not account for all real-world trading costs, slippage, or market impact
  • Backtests may suffer from survivorship bias, look-ahead bias, or data-mining bias
  • Historical data may contain errors or omissions
  • Market conditions that existed during the backtest period may not recur
  • Strategy performance may degrade over time as strategies become more widely known

3.4 Investment Risk

All investments involve risk, including the possible loss of principal. You could lose some or all of your invested capital. The strategies presented on BestFolio may involve leverage, concentrated positions, or frequent trading, which can amplify both gains and losses.

3.5 Third-Party Data

BestFolio relies on data from third-party sources. While we endeavour to use reliable sources, we do not guarantee the accuracy, completeness, or timeliness of any data.

3.6 Your Responsibility

You are solely responsible for your own investment decisions. You should consult with a qualified financial professional before making any investment decisions.

4. Subscription and Billing

4.1 Subscription Plans

BestFolio offers the following subscription plans:

  • Monthly Plan: USD $29.00 per month
  • Annual Plan: USD $299.00 per year

Prices are subject to change. We will provide reasonable notice of any price changes to existing subscribers.

4.2 Paddle as Merchant of Record

All billing, payment processing, and subscription management for BestFolio is handled by Paddle.com Market Limited (“Paddle”), which acts as our Merchant of Record. This means:

  • Paddle is the legal seller of BestFolio subscriptions. When you purchase a subscription, your contract of sale is with Paddle, not directly with BestFolio.
  • Paddle handles all payment processing, invoicing, sales tax/VAT calculation and remittance, and currency conversion.
  • Your payment information is collected and stored exclusively by Paddle. BestFolio never receives, processes, or stores your payment information.
  • Paddle's terms of service and privacy policy apply to payment transactions. You can review them at paddle.com/legal/terms and paddle.com/legal/privacy.

4.3 Billing Cycle

  • Monthly subscriptions are billed on the same date each month.
  • Annual subscriptions are billed on the same date each year.
  • Your subscription renews automatically at the end of each billing cycle unless you cancel.

4.4 Cancellation

You may cancel your subscription at any time through the Paddle customer portal or by contacting us. Upon cancellation:

  • Your subscription will remain active until the end of the current billing period.
  • You will not be charged for subsequent billing periods.
  • No partial refunds will be issued for unused portions of a billing period.

4.5 Refund Policy

Because Paddle is the Merchant of Record, refund requests are processed through Paddle in accordance with their policies and applicable consumer protection laws. If you believe you are entitled to a refund, please contact us at [email protected] and we will work with Paddle to resolve the matter.

EU consumers have the right to withdraw from a digital service purchase within 14 days under the Consumer Rights Directive, subject to applicable exceptions.

5. Account Registration and Security

5.1 Account Creation

To use the Service, you must create an account by providing accurate and complete information. You must be at least 18 years of age.

5.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5.3 One Account Per User

Each subscription is for a single individual user. You may not share your account credentials or allow others to access the Service through your account.

6. Intellectual Property

6.1 Service Content

The Service, including its design, features, code, text, graphics, and user interface, is owned by BestFolio and protected by copyright, trademark, and other intellectual property laws.

6.2 Strategy Implementations

The strategies presented on BestFolio are our independent implementations and interpretations of allocation methodologies described in publicly available academic papers, books, and practitioner research. We credit the original authors and researchers whose published work forms the basis of these strategies.

BestFolio is not affiliated with, endorsed by, or sponsored by any of the original strategy authors or their organizations. Our implementations may differ from the authors' own proprietary versions or current recommendations. Strategy names used on the platform are descriptive references to the underlying methodology and do not imply any commercial relationship with the original authors.

6.3 Content Takedown Policy

We respect intellectual property rights. If you are the original author of a strategy implemented on BestFolio and believe that our implementation infringes on your rights, please contact us at [email protected] with the following information:

  • Identification of the strategy or content you believe infringes your rights
  • Evidence of your ownership or authorship
  • A description of the specific concern
  • Your contact information

We will review all takedown requests promptly and in good faith. If we determine that a modification or removal is warranted, we will take appropriate action within a reasonable timeframe.

6.4 User License

Subject to these Terms and your active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial investment research purposes.

6.5 Restrictions

You may not:

  • Copy, redistribute, or publish any content from the Service without prior written consent
  • Use the Service to create a competing product or service
  • Scrape, crawl, or use automated means to access the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell or sublicense access to the Service

7. Limitation of Liability

7.1 No Liability for Investment Losses

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BESTFOLIO, ITS OWNER, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INVESTMENT LOSSES, TRADING LOSSES, OR FINANCIAL DAMAGES OF ANY KIND ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

7.2 General Limitation

To the maximum extent permitted by applicable law, in no event shall BestFolio's total aggregate liability to you exceed the amount you have paid to BestFolio (via Paddle) in the twelve (12) months preceding the event giving rise to the claim.

7.3 Exclusion of Certain Damages

To the maximum extent permitted by applicable law, BestFolio shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

7.4 No Warranty

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied.

7.5 EU Consumer Rights

Nothing in these Terms shall limit or exclude any liability that cannot be limited or excluded under applicable law, including applicable EU consumer protection laws.

8. Indemnification

You agree to indemnify, defend, and hold harmless BestFolio, its owner, and its agents from and against any claims, liabilities, damages, losses, and expenses arising from or related to your use of the Service, your investment decisions, your violation of these Terms, or your violation of any third party's rights.

9. Service Availability and Modifications

We strive to maintain continuous availability of the Service but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

10. Termination

10.1 Termination by You

You may terminate your account at any time by cancelling your subscription and contacting us to request account deletion.

10.2 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including if we reasonably believe you have violated these Terms.

10.3 Effect of Termination

Upon termination, your right to access the Service ceases immediately (or at the end of your current billing period, if you cancelled). Provisions that by their nature should survive termination shall survive, including Sections 3, 6, 7, 8, and 11.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hungary.

11.2 Jurisdiction

Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Budapest, Hungary.

11.3 EU Consumer Disputes

If you are a consumer residing in the European Union, you may also be entitled to use the European Commission's Online Dispute Resolution (ODR) platform, available at ec.europa.eu/consumers/odr.

12. General Provisions

These Terms, together with the Privacy Policy, constitute the entire agreement between you and BestFolio regarding the Service. If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver.

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such notification constitutes acceptance of the updated Terms.
